Privacy Policy

Permitted Cooks

This Privacy Policy explains how Permitted Cooks ("PC," "we," "us," or "our"), operated by What's Cookin' Tonight LLC, collects, uses, and shares personal information when you use our platform. It applies to cooks and customers who use our services in California, including Permitted Cooks storefronts and the What's Cookin' Tonight marketplace. By using our services, you agree to this policy. Please also see our Terms of Use.

1. Information We Collect

We collect the following categories of personal information:

Account and identity information. Your name, email address, phone number, and account role (Cook or Foodie). For Cooks, we also collect information confirming your MEHKO permit and food safety certification status.

Location information. Approximate location, stored as latitude and longitude, used to show you nearby dishes. On your first visit we may derive approximate location from your IP address. We do not track your location continuously.

Order and transaction information. Dishes ordered, order amounts, platform fees, sales tax, pickup codes, and ratings and reviews.

Payment information. Payments are processed by Stripe. Stripe collects and processes your payment card details directly. For Cooks, Stripe also collects identity and tax information needed to set up payouts (such as a tax identification number) directly through its onboarding. PC does not store full payment card numbers.

Communications. Messages exchanged between Cooks and Foodies through the in-app messaging feature, and messages you send us.

Content. Photos, dish descriptions, and reviews you submit.

Device and usage information. IP address, browser type, device information, and general usage activity on the platform.

We collect this information directly from you, automatically as you use the platform, and from service providers such as our payment processor.

2. How We Use Your Information

We use personal information to:

  • operate the platform, including creating accounts, processing orders, and enabling pickup;
  • process payments and, for orders placed through the What's Cookin' Tonight marketplace, calculate, collect, and remit applicable California sales tax;
  • send transactional text messages such as order confirmations, pickup codes, and notifications;
  • show you relevant nearby dishes based on approximate location;
  • analyze dish photos using an artificial intelligence service to help Cooks present their food (see Section 3);
  • improve the platform and user experience;
  • detect, prevent, and address fraud, safety issues, and violations of our Terms of Use and Community Guidelines;
  • comply with legal, tax, and accounting obligations; and
  • measure and support our advertising (see Section 5).

3. Photos and AI Processing

Dish photos you upload are stored through our image provider (Cloudinary) and may be displayed publicly on the platform and in social sharing previews. To help Cooks present their dishes, we process dish photos using an artificial intelligence service provided by Anthropic. This processing is used to generate guidance and descriptions related to the food image. We do not use it to identify individuals.

4. Who We Share Information With

We share personal information only as described here.

Service providers that perform functions on our behalf, under terms that limit their use of the information to providing their service to us:

  • Stripe, for payment processing and payouts (stripe.com/privacy)
  • Twilio, for sending text messages (twilio.com/legal/privacy)
  • Cloudinary, for photo storage
  • Anthropic, for AI analysis of dish photos
  • Neon, for database hosting
  • Vercel, for application hosting

Other users, to the extent needed to complete a transaction. Pickup details are shared with a Foodie once an order is confirmed and marked ready. Cook names and dish content are shown publicly as part of listings.

Advertising and analytics partners (see Section 5).

Legal and safety. We may disclose information if required by law, to respond to legal process, to enforce our Terms, or to protect the rights, safety, or property of users, the public, or PC.

5. Advertising, “Sale,” and “Sharing” of Personal Information

We do not sell your personal information for money.

We do use advertising and analytics technologies, including the Meta Pixel, that send certain identifiers and activity information to advertising partners so we can measure and target our advertising. Under California law, this type of disclosure for cross-context behavioral advertising is treated as "sharing" of personal information, and in some cases may be treated as a "sale." We want to be transparent that this sharing occurs.

Text messaging data is excluded. The advertising and analytics sharing described above never includes your mobile phone number, your SMS opt-in information, or your consent to receive text messages. Mobile information and text messaging originator opt-in data and consent are not shared with any third parties or affiliates for marketing or promotional purposes.

You can limit this sharing by:

  • using the ad and privacy settings offered by the advertising partner; and
  • disabling advertising cookies through your browser settings or by enabling Global Privacy Control in your browser.

6. Cookies and Tracking Technologies

We use cookies and similar technologies to operate the platform, remember your preferences, measure usage, and support advertising. You can control cookies through your browser settings. We will describe how we respond to Do Not Track and Global Privacy Control signals as we expand our privacy controls.

7. Location Data

We collect approximate location to show you nearby dishes. We do not track your location continuously or in the background. A Cook's pickup address is shared with a Foodie only after an order is confirmed and marked ready.

8. Data Retention

We retain personal information for as long as your account is active and as needed to provide the platform. We also retain certain information after account closure where we are required or permitted to do so, including for tax, accounting, legal, fraud-prevention, and dispute-resolution purposes. As a marketplace facilitator, we are required to keep transaction and tax records, so some order information is retained even after a deletion request, to the extent the law allows or requires.

You may request deletion of your personal information by emailing hello@whatscookintonight.com. We will honor your request except for information we are required or permitted to keep.

9. Your Privacy Rights

If you are a California resident, you have the right to:

  • Know and access the personal information we have collected about you, including categories and specific pieces.
  • Correct inaccurate personal information.
  • Delete your personal information, subject to the exceptions in Section 8.
  • Opt out of the sale or sharing of your personal information (see Section 5).
  • Limit the use of sensitive personal information, where applicable.
  • Not be discriminated against for exercising these rights.

To exercise any of these rights, email hello@whatscookintonight.com. We will verify your request by confirming information associated with your account, and we will respond within the timeframe required by law (generally within 45 days). You may use an authorized agent to submit a request on your behalf, subject to verification.

10. Children

PC is intended only for users who are 18 or older. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us information, contact us and we will delete it.

11. Security

We use reasonable, industry-standard measures to protect personal information. No system is completely secure. Please use a strong password and contact us immediately at hello@whatscookintonight.com if you suspect unauthorized access to your account.

12. Changes to This Policy

We may update this policy from time to time. If we make material changes, we will notify you and prompt you to re-agree on your next login. The "last updated" date above reflects the most recent version.
